Obtaining Medical Files after Forced Psychiatric Hospitalization

In 2001, the Association for Civil Rights in Israel (ACRI) submitted a lawsuit to the Tel Aviv District Court in the name of a woman who was forcibly hospitalized in a psychiatric hospital and requested her medical file. This request raises a fundamental and important question concerning the right of anyone who has been forcibly hospitalized in a psychiatric institution to receive all of the medical information held by the hospital pertaining to his or her case.

The District Court rejected the suit. The woman submitted an appeal to the Supreme Court through a private attorney, and the Court accepted the appeal and ruled that the matter should be discussed by the Ethics Committee according to the procedure set out in the Patients’ Rights Law.
