{"id":7771,"date":"2013-12-19T10:16:05","date_gmt":"2013-12-19T08:16:05","guid":{"rendered":"https:\/\/law.acri.org.il\/en\/?p=7771"},"modified":"2013-12-19T10:16:05","modified_gmt":"2013-12-19T08:16:05","slug":"ngo-bill-dec13","status":"publish","type":"post","link":"https:\/\/law.acri.org.il\/en\/2013\/12\/19\/ngo-bill-dec13\/","title":{"rendered":"A New Law to Limit Foreign Donations to Non-Profit Organizations"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p>On Sunday December 15, the Ministerial Committee for Legislative Affairs approved (8 in favor, 4 against) a bill that would tax donations from foreign state entities to certain Israeli NGOs who implicitly or explicitly support certain actions such as: calling for boycotts, divestment or sanctions against Israel, calling for the prosecution of Israeli soldiers at international tribunals, etc.<\/p>\n<p>&nbsp;<\/p>\n<p><a href=\"https:\/\/law.acri.org.il\/en\/knesset\/amutot-law\/\" target=\"_blank\">This bill<\/a> is the most recent incarnation of an ongoing campaign in recent years to limit international funding to various causes disliked by the government. <a href=\"https:\/\/law.acri.org.il\/en\/knesset\/bill-on-foreign-funding-of-ngos-hybrid-version\/\" target=\"_blank\">Similar bills<\/a> that have been initiated by Members of Knesset in recent years have been unsuccessful.<\/p>\n<p>&nbsp;<\/p>\n<p>ACRI has sent a <a href=\"https:\/\/law.acri.org.il\/en\/wp-content\/uploads\/2013\/12\/AmutotLawPP.pdf\" target=\"_blank\">concise position paper<\/a> to the ministerial committee, clearly articulating how the bill infringes upon free speech and is inconsistent with basic democratic principles.<\/p>\n<p>&nbsp;<\/p>\n<p>In addition, Attorney General Yehuda Weinstein has expressed that this bill violates a series of constitutional rights and that the \u2018tax penalty\u2019 is:<\/p>\n<p style=\"padding-left: 30px;\"><em>\u201ca kind of punitive measure, which aims to create a \u2018chilling effect\u2019 and prevent donations to organizations, thus harming free discourse in Israel, which is one of the key democratic anchors of the state.\u201d<\/em><\/p>\n<p>&nbsp;<\/p>\n<p><strong>It is unfortunate and alarming that we must reiterate the principles of a democratic system of government. The existence of democracy, and a flourishing democracy in particular, requires that freedom of expression, freedom of association, and the freedom to public criticize and protest be protected. <\/strong>This is necessary with regards to all opinions and attitudes, even those not to the liking of everyone.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>ACRI Executive Director Hagai El-Ad<\/strong>: &#8221; This is the latest attempt to advance an previously rejected bill that even the previous government refused in the end to promote.
