{"id":5742,"date":"2013-02-14T15:44:12","date_gmt":"2013-02-14T13:44:12","guid":{"rendered":"https:\/\/law.acri.org.il\/en\/?p=5742"},"modified":"2013-02-14T16:12:05","modified_gmt":"2013-02-14T14:12:05","slug":"hcj-cancels-zoabi-petition","status":"publish","type":"post","link":"https:\/\/law.acri.org.il\/en\/2013\/02\/14\/hcj-cancels-zoabi-petition\/","title":{"rendered":"High Court refuses to rule on the denial MK Zoabi&#8217;s parliamentary rights"},"content":{"rendered":"<p>&nbsp;<\/p>\n<p>An expanded panel of seven Supreme Court Justices yesterday (February 13, 2013) <a href=\"http:\/\/elyon1.court.gov.il\/files\/10\/450\/063\/s16\/10063450.s16.pdf\">dismissed a petition<\/a> filed by MK Hanin Zoabi together with <strong>Adalah<\/strong> and the <strong>Association for Civil Rights in Israel<\/strong>. The petition was filed as a result of the outgoing Knesset&#8217;s <a href=\"https:\/\/law.acri.org.il\/en\/2011\/04\/27\/hcj-orders-knesset-to-explain-rescindment-of-mk-zoabis-rights\/\">decision to revoke her parliamentary rights<\/a> following statements she made during the Gaza flotilla incident in May 2010.<\/p>\n<p>&nbsp;<\/p>\n<p>The court explained that the rationale behind the decision to dismiss the petition was that since the dissolution of the 18th Knesset\u00a0rendered its decision to revoke MK Zoabi&#8217;s parliamentary rights inconsequential, the Court saw no reason to &#8220;devote its limited resources to an examination of a theoretical question.&#8221;<\/p>\n<p>&nbsp;<\/p>\n<p>Adalah and ACRI responded by making clear that <strong>&#8220;the court finished hearing arguments on this case months before the Knesset decided to call for early elections, and had a judgment been handed down in a timely manner, we could have prevented the adoption of an illegal and undemocratic step that exemplifies the tyranny of the majority.&#8221;<\/strong><\/p>\n<p>&nbsp;<\/p>\n<p>The 18th Knesset revoked, among other parliamentary rights, MK Zoabi&#8217;s diplomatic passport and her right to be indemnified for legal expenses.<\/p>\n<p>In the petition, Attorneys\u00a0<strong>Hassan Jabareen<\/strong>\u00a0from Adalah and\u00a0<strong>Dan Yakir<\/strong>\u00a0from ACRI argued that the revocation of Zoabi&#8217;s rights sets dangerous precedent that enables representatives of the majority in the Knesset to \u201cpunish\u201d Knesset members for their political views, which contradicts the main purpose of parliamentary immunity: to protect the freedom of political activity of all Knesset representatives in an equal manner.
